by the provisions about "indication" in Article 5. If any buyer
violates the provisions and reexports the textiles to countries
imposing import quotas, the Ministry of Foreign Economic Relations
shall notify Chinese export enterprises to cease their trading
relations with it.
@@ Article 9. The Ministry of Foreign Economic Relations or the
foreign economic relations and trade departments of various
provinces, municipalities under the central administration and
autonomous regions and cities following the State plans may carry
out regular or irregular checkups of relevant export
enterprises. If any enterprise found engineering or participating
in illegal reexport of textiles, it shall be punished according to the
relevant provisions of the procedures.
@@ Article 10. The customs shall punish, according to the
"Detailed Rules for the Implementation of the Administrative
Punishment of the Customs of the People's Republic of China",
enterprises found reexporting textiles by indicating the place of
origin of other countries or regions on the labels, tags and packages
or other means.
@@ Article 11. Export enterprises shall accept the examination of
their products by the commodity inspection organizations. The
commodity inspection organizations shall punish, according to the
"Rules for the Implementation of the Law on the Inspection of
Import and Export Commodities of the People's Republic of China",
enterprises which attempt to illegally reexport textiles by
changing the place of origin on the labels, tags and packages or by
other means.
@@ Article 12. Criminal punishment shall be meted out to the
individuals or legal persons if the cases of reexport activity are
serious enough to constitute a crime.
@@ Article 13. The Ministry of Foreign Economic Relations and
Trade shall award those who expose or provide clues to illegal
textile reexport activities.
@@ Article 14. The right of interpreting the regulations shall
rest with the Ministry of Foreign Economic Relations and Trade.
Article 15. The regulations shall come into force from the
date on promulgation.
