exporting enterprise or a technologically advanced enterprise. A
foreign investment enterprise established after 1 July 1987 may,
following submission of an application for examination and
approval, undergo preliminary assessment for confirmation as
an exporting enterprise or technologically advanced enterprise at
the same time as the project proposal is examined and approved,
and a case which meets the provisions of these Measures shall
undergo a re-examination every 6 months and a certificate of
confirmation shall be issued after each evaluation.
@@ Article 9. The format of the Application for Confirmation
as an Exporting Enterprise, the Application for Confirmation as a
Technologically Advanced Enterprise and the Certificate of
Confirmation shall be determined uniformly by the Ministry of
Foreign Economic Relations and Trade. The Certificate of
Confirmation shall be signed and stamped by the Municipal Office for
Industry. The original of the Certificate of Confirmation shall be
given to the enterprise for it to retain, and copies shall be sent to
the relevant departments for filing for use as a reference when
handling matters on preferential treatment. At the same time,
together with the enterprise application, copies of the Certificate
of Confirmation shall be submitted to the Ministry of Foreign
Economic Relations and Trade and the State Economic Commission for
filing.
@@ Article 10. A foreign investment enterprise shall, in
accordance with relevant State regulations, draw up its own
annual export plan and regularly submit export performance
statistics and reports on its various economic targets and
technology targets to the Municipal Office for Industry as a
basis for assessment in respect of confirmation as an exporting
enterprise or technologically advanced enterprise.
@@ Article 11. The Municipal Office for Industry, in conjunction
with the relevant departments in charge, shall each year, on
the basis of the provisions of Article 2, 3 and 4 of these Measures,
examine and assess such areas as an enterprise's export plan, annual
export performance, technology targets, product quality, the degree
to which the goods are produced domestically, annual foreign
exchange balance and overall economic results.
@@ Article 12. The Municipal Office for Industry shall each year
compile a list of the exporting enterprises and technologically
advanced enterprises which have passed assessment and shall issue
this list to the relevant departments. These enterprises may
subsequently continue to receive the various items of preferential
treatment in the new year.
If an enterprise fails to pass the year-end assessment, it shall
