mortgaging, the lessee, inheritor or
mortgagor should pay to the city land bureau land registration
and administration fees, which are subject to adjustments every three
years.
@@ Article 32. Land registration fees are charges for procedures
in the registration of a lease, changes in a lease and mortgage on
a lease. The charges are Rmb 200 yuan for a lease registration,
Rmb 200 yuan for a change of lease registration and Rmb 100 yuan for a
mortgage registration.
Land administration fees are charges covering sublease or
lease inheritance. The rate of payment for land administration fees
is 3% of the selling price, the rate for grant and inheritance 2% of
present value and the rate for a swap transaction 3% of the present
value of each lease.
@@ Article 33. Taxation matters involved in a lease or sublease
shall be handled in accordance with state regulations.
@@ Article 34. In the case of a dispute over a lease or
sublease, the parties concerned can request arbitration by
arbitration offices of the People's Republic of China, or have recourse
to legal action.
@@ Article 35. Cases of illicit buying and selling, leasing or
subleasing land use rights in violation of the Measures are subject to
penalties to be imposed by the city land bureau according to law.
Violations of criminal law in the process of land leasing and
subleasing will be prosecuted by legal institutions.
@@ Article 36. In case of a revision of the Measures, the
revision will not backtrack to the past contracts. But the
lessee can enjoy, on application, the preferential treatment for
which he is eligible as a result of the revision, excepting cases
otherwise regulated by law.
@@ Article 37. The city land bureau is the authority for
interpretation of the Measures.
@@ Article 38. The Measures will be put into practice on the
day of promulgation.
