;
(2) to formulate and execute training plans; and
(3) to complete training on schedule and ensure training quality.
Article 103 If the technical training needs necessary sites, facilities
and testing conditions, the contracting parties should stipulate in the
contract the obligations of providing and keeping the sites, facilities
and testing conditions. In absence of such an agreement in the contract,
the entrusting party should be responsible to provide and keep them.
Article 104 If the trainer party discovers the trainees do not meet the
conditions set in the contract or the entrusting party discovers that
the trainers do not meet the conditions set in the contract, they should
timely notify and demand each other for a change and the party receiving
the notice should make changes within the agreed time limit. If no
notice is served or no change is made according to agreement, the party
in default is held responsible.
Article 105 If the entrusting party to a technical training contract
fail to perform the contract, it should bear the following
responsibilities:
(1) Paying remuneration in full if the trainees fail to meet the
contractual requirements, thus affecting the training quality. The
trainer party has the right to cancel the contract if the entrusting
party fails to send trainees or qualified trainees two months after the
due date. The entrusting party should compensate for the losses caused
thereby to the trainer party.
(2) Paying remuneration retroactively if it fails to pay up according to
the contractual amount, pay default fines or compensate for the losses.
Article 106 The trainer party to a technical training contract should
bear the following responsibilities for failing to perform the contract:
(1) To accept less or no remuneration if the trainer assigned fails to
meet contractual requirements, thus affecting the training quality. To
pay compensation for the losses caused by the rightful termination of
the contract by the entrusting party due to failure on the part of the
trainer party to assign trainers or to change qualified trainers two
months after the due date.
(2) To return all or part of the remuneration paid, pay default fines or
compensate for the losses for failing to conduct training according to
plan or project, thus causing training result unconformable to the
contractual requirements.
Article 107 A technical medium contract refers to a contract concluded
by one party with another for providing liaison, making introductions or
organizing industrial development on the strength of its knowledge,
technology, experience and information, in the service of the signing of
a technical contract with a third party and for providing services in
performing the contract.
