rights and interests. If the advisory party wishes to sign a technical
consultation contract with the rival of the entrusting party on the
technical project of the same category within the validity period of the
contract, that party should have the consent of the entrusting party.
Article 86 If the entrusting party to a technical consultation contract
fails to pay remuneration as scheduled, the entrusting party should pay
it retroactively and pay default fines or compensate for the losses. If
the entrusting party delays supplying the contractual data and materials
or the data and materials are found to have serious defaults which have
impeded work process and quality, the entrusting party should pay due
remuneration and pay default fines or compensate for the losses if any.
If the entrusting party fails to provide or refurnish relevant technical
materials, data or working conditions two months after the dute date,
thereby causing work stoppage on the part of the advisory party, the
advisory party has the right to cancel the contract and the entrusting
party should pay default fines or compensate for the losses, except
otherwise provided in the contract.
Article 87 If the advisory party to a technical consultation contract
delays delivering advisory report and comments, it is liable to default
fines. If the advisory report or comments fail to meet the requirements
prescribed in the contract, the remuneration should be reduced or
waived. If the advisory party refuses the submission of advisory report
and comments or the advisory report and comments are too poor to have
any reference value, the advisory party should not claim for
remuneration; instead it should pay default fines or compensate for the
losses.
If the advisory party fails to start investigation and argumentation two
months after the date of receiving the technical materials and data
provided by the entrusting party, the entrusting party has the right to
cancel the contract. The advisory party should return the remuneration
paid, pay default fines or compensate for the losses, except otherwise
provided in the contract.
Article 88 The contracting parties may stipulate in the technical
consultation contract the methods for examination and acceptance or for
appraisal. In absence of such an agreement, appraisal should be
conducted according to the general, practicable requirements.
Article 89 A contract is terminated when the advisory report and
opinions are deemed as being qualified and accepted. The advisory party
is free from any obligation if losses are incurred from the execution of
the decision made according to the advisory report and opinions, except
the cases where a contract requires the advisory party to make the
