1988.11.12 STATE ADMINISTRATION FOR THE INSPECTION OF IMPORT & EXPORT COMMODITY PROVISIONS ON INSPECTION SAMPLES OF IMPORT AND EXPORT COMMODITIES (Promulgated by the State Administration of Import and Export Commodity Inspection on November 12, 1988) @@ Article 1. The present Provisions are formulated with a view to strengthening the administration in inspection samples of import and export commodities. @@ Article 2. Sampling of import and export commodities should be performed according to the foreign trade contracts, standards and the relevant stipulations. All drawn samples should be representative and resampling should be avoided for different testing items in the same batch of cargo. @@ Article 3. Before sampling import commodities, no inspectors can be dispatched to the departments concerned for sampling unless it has been checked and approved by the person in charge of the competent division. The sampling record should be made and each sample should be marked with code number. After sampling, the receipt should be completed in duplicate, one for the applicant and the other for file. As to the drawn samples, there must be a special person responsible for control, check ,acceptance and registration in the inspection division. @@ Article 4. For the up-to-standard export commodities undergone inspection, a certain quantity of representative samples should be retained until the validity of time of claim stipulated in the contract expires; for those commodities concerning claims lodged for compensation from abroad, the samples should be retained until the claims are settled. If the validity of time of claims are not stipulated in the contract, the drawn samples should be retained for more than half a year for check and reinspection. For those commodities of a unstablilized quality and subject to variance, the samples should be retained for an appropriate period of time or needn't retaining. @@ Article 5. For those substandard import commodities undergone inspection, if claims are to be made against foreign traders, or the settlement of account must be on the basis of inspection certificates issued by the commodity inspection authorities, a certain quantity of representative samples should be retained or the entire lot of the consignment is retained by the receivers or endusers until the claims are settled. If the validity of time of claim isn't clearly prescribed, the samples should be retained for one year of time limit. For those valuable to scientific research, the time of retaining can be extended adequately. @@ Article 6.
