BEIJING MUNICIPALITY
REGULATIONS OF BEIJING MUNICIPALITY ON SUPERVISION OF LABOUR PROTECTION
(Adopted 25 September 1987 by the 39th Session of the Standing Committee
of the 8th Beijing Municipal People's Congress.)
Article 1 These Regulations are formulated in accordance with the
Constitution of the People's Republic of China and the relevant State
laws and statutory regulations and in conjunction with the actual
conditions of Beijing Municipality, in order to strengthen the
supervision of labour protection and ensure the safety and health of
employees in the work place.
Article 2 These Regulations shall apply to all enterprises within the
Beijing Municipal administrative area, unless State laws or statutory
regulations stipulate otherwise.
Article 3 The Beijing Municipal Labour Bureau shall be the organ in
charge of supervising the implementation of labour protection measures
throughout Beijing Municipality and shall directly supervise labour
protection in key enterprises. District and county labour bureaus shall
be the organs in charge of supervising labour protection in the various
districts and counties and shall be responsible for supervising labour
protection in their local administrative areas.
Neighborhood offices and rural and township people's governments shall
be responsible for supervising labour protection in their local
neighbourhoods and rural and township enterprises respectively and,
depending on local requirements, shall establish offices or provide
full-time or part-time positions for persons to undertake such work.
Article 4 The principle functions of an organ in charge of supervising
labour protection shall be to:
(i) supervise enterprises in their implementation of labour protection
laws, statutory regulations, procedures and relevant standards;
(ii) urge enterprises to provide employees with education and technical
training in safety matters, and conduct uniform examinations or engage a
relevant unit to examine those employees who undertake special work
positions and issue certificates accordingly;
(iii) supervise and examine the implementation of labour protection
measures by enterprises and the allocation and use, in accordance with
State regulations, of funds for technical measures for labour
protection;
(iv) examine the design, and conduct an acceptance inspection, of labour
protection related technical facilities of newly constructed, renovated
or expanded enterprises or major technology renovation projects;
(v) issue directives on labour protection supervision to enterprises
which fail to rectify serious hidden dangers which may result in
accidents or which fail to improve inferior working conditions and
