@@ Article 18. If and employee who has received training funded
by the joint enterprise resigns or leaves voluntarily in
accordance with the provisions of item (4) of Article 15, after the
training period, but before the expiry of the labour contract term,
the employee shall compensate the enterprise for a certain amount of
the training fee in accordance with the provisions of the labour
contract.
@@ Article 19. The future of Chinese employees whose contracts
expire or are terminated shall be dealt with in one of the following
ways:
(1) Those recruited from within the department in charge of the
enterprise or the Chinese investment party or as a graduate student
from one of the various schools shall be accepted back by the
department in charge of the enterprise or the Chinese investment
party and work shall be found elsewhere, unless the party was
dismissed in accordance with the provisions of item (3) of Article 12,
or resigned in accordance with the provisions of item (4) of Article 15.
(2) Those recruited by a joint enterprise through public
advertisement from among persons in Shanghai Municipality and
surrounding towns awaiting employment or currently employed and those
dismissed in accordance with the provisions of item (3) of Article 12
or who resigned in accordance with the provisions of item (4) of
Article 15 shall all return to their original district and register
with the local labour department for employment. On re-employment or
after working, the periods of service before and after termination
may be calculated consecutively.
(3) Those recruited from the countryside by a joint enterprise shall
return to the countryside.
(4) Those engaged or seconded by a joint enterprise from other
provinces or cities shall return to their original area.
@@ Article 20. A joint enterprise shall list educational training
fees as expenses and use these fees to train employees so that their
professional skills are upgraded continuously and meet the
requirements of the enterprise.
@@ Article 21. Senior management personnel engaged by the
Board of Directors of an enterprise shall have a sound
understanding of their professional area of work, be capable
administrators, be familiar with the law and be able to co-operate
with others on matters of official business. If amendments to their
areas of work need to be made during their term of office, the
approval of the Board of Directors shall be obtained. The
department in charge of the enterprise shall support them in their work.
@@ Article 22. A joint enterprise shall submit a report and
statistical tables on employee wages in accordance with the
