CHAPTER I GENERAL PRINCIPLES
@@ Article 1. These Regulations are formulated in accordance with
the Law of the People's Republic of China on Sino-foreign Joint
Equity Enterprises and its implementing regulations, the Regulations
of the People's Republic of China on Labour Management in
Sino-foreign Joint Equity Enterprises and other relevant laws and
administrative legislation, in conjunction with the actual conditions
in Shanghai Municipality, in order to strengthen labour and personnel
administration in Sino-foreign joint equity enterprises in Shanghai
Municipality and to accelerate the development of Sino-foreign
joint equity enterprises.
@@ Article 2. These Regulations shall apply to all Sino-foreign
joint equity enterprises (hereinafter referred to as joint
enterprises) established in Shanghai Municipality.
CHAPTER II EMPLOYEE RECRUITMENT, DISMISSAL AND RESIGNATION
@@ Article 3. A joint enterprise may determine its own
organisational structure and personnel compilation in accordance
with its production and operational requirements. The labour plans
determined by the Board of Directors of an enterprise shall be
implemented under the supervision of the department in charge of the
enterprise, the Shanghai Municipal Labour Bureau and the Shanghai
Municipal Personnel Bureau, following submission of its details to the
above departments for filing.
@@ Article 4. Chinese engineering and technical personnel,
management personnel and skilled workers required by a joint
enterprise may be recommended by the department in charge of the
enterprise and the Chinese investment party from among its own
affiliations or may also be recommended by the party in charge of the
enterprise from among the graduating year of students at universities,
colleges, poly-technics and technical schools, or applications may be
publicly invited from within Shanghai Municipality. Those who meet
the requirements of an examination set by the enterprise shall be
recruited. If a small number of specialised personnel are
unavailable within the Municipality, applications may be invited
