HAINAN PROVINCE
INTERIM PROVISIONS OF HAINAN PROVINCE ON LABOR MANAGEMENT IN ENTERPRISES
WITH FOREIGN INVESTMENT
(Promulgated by Decree No. 7 of the People's Government of Hainan
Province on December 6,1990)
Article 1 These Provisions are formulated in accordance with the
relevant laws and regulations of the State in order to strengthen the
labor management in the equity joint ventures, contractual joint
ventures and wholly foreign-owned enterprises (hereinafter referred to
as "enterprises with foreign investment") and to guarantee the legal
rights and interests of investors, staff and workers of enterprises with
foreign investment.
Article 2 These Provision shall apply to the enterprises with foreign
investment established within the jurisdiction of Hainan Province
(hereinafter to as "the Province").
Article 3 The labor administrative departments in charge of the people's
governments at all levels shall be responsible for the implementation of
these Provisions and the supervision and examination thereof.
Article 4 Enterprises with foreign investment may decide by themselves
the organizational structure, personnel system, manpower, payroll and
plan for distribution of wages.
Article 5 In employing staff and workers, enterprises with foreign
investment shall submit information concerning the type of work and
numbers of staff and workers to the local labor administrative
department in charge and go through the relevant procedures pursuant
to the stipulations of labor management and current control system of
the State. The labor administrative departments in charge shall do
good organization, coordination and service work on the basis of the
need for labor force by enterprises and the principle of person from
city, county first and countryside second, from locality first and
non locality second, from the Province first and others second.
Article 6 If technical personnel in a specific field, high grade
technical workers and workers in special type of work needed by an
enterprise with foreign investment are not available in the city or
county where the enterprise is located, the enterprise may employ
persons who come from other cities or counties in the Province and if
not available in the Province, may employ persons from outside of
the Province. The labor administrative departments in the districts
concerned shall make good organization, coordination and service work.
If enterprises with foreign investment need to employ labor force from
the countryside, it must be subject to the examination of the local
labor administrative department in charge and the approval of the
Personnel and Labor Bureau of the Province.
